1. Acceptance of Terms

WetDawg.com provides its service to you, and as users, you are subject to the following Terms of Service, which may be updated by us from time to time without notice. In addition, when using particular WetDawg.com services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Membership and Usage Restrictions

A) My WetDawg Membership is available to any person over the age of 13 who registers and accurately provides all the required information, provides a legitimate electronic mail address and obtains a unique WetDawg.com Member Name and password. Membership is non-transferable. Children under the age of 13 can only register with the express consent of a parent or guardian.

B) All membership information must be accurate and belong to the person registering. Invalid, incomplete, or falsified information will result in the immediate termination of all membership privileges for that user and, possibly a permanent ban restricting the member from using any of WetDawg.com services at any time.

C) Usage of this site is restricted to persons over the age of 13 unless a person aged 13 or under is accompanied by a parent or legal guardian at all times. WetDawg.com acts in accordance with all child protection acts and therefore requires that any users under age 13 have their legal guardian contact WetDawg.com in writing before signing up or partaking in any forms of membership within the WetDawg.com website.

3. Use of information and services

A) The information provided on WetDawg.com is intended only as a reference. WetDawg.com does not certify or endorse any companies listed on the site. WetDawg.com assumes no responsibility for any consequence resulting from any action or inaction taken based on the information, services or other material on this site.

B) The water (rivers, ocean, lakes) descriptions provided by WetDawg serve as a general guide and what to expect. But, because the character of rivers, lakes, and oceans and its surroundings can change significantly in a day, month or year, the information should not be regarded as an exact description of what you will experience on a given day. It is the responsibility of each person to find out what lies ahead and be able to deal with situations as they arise. Playing in rivers, oceans or lakes in any kind of watercraft is inherently risky. Each individual is responsible for his/her own safety. The authors of the river descriptions on the WetDawg site are in no way responsible or liable for any loss of life or property that may occur when playing in rivers, lakes or ocean. C) The tips and techniques presented on our site are written by qualified professionals in the field. However, the tips are meant to be used only as guides and are not substitutes for professional instruction or real world experience.

D) Commercial uses of WetDawg.com are strictly prohibited unless prior written consent from WetDawg.com has been granted. You agree that you will not use WetDawg.com for chain letters, junk mail, 'spamming', solicitations (commercial or non-commercial) or bulk communications of any kind including but not limited to distribution lists to any person who has not given specific permission to be included in such a list.

E) You may not post or transmit material that is libelous, defamatory, vulgar, obscene, fraudulent, harmful, threatening, abusive, hateful, or bigoted that violates the property rights of others, that violates the privacy or publicity right of others, that advocates illegal activity or discusses illegal activities with the intent to commit them, that uses unauthorized copyrighted material, or that is in violation of applicable laws. In addition, you may not interfere with other users' use and enjoyment of this site. WetDawg.com reserves the right to refuse site access to anyone that violates these Terms of Services.

F) Any and all content posted for inclusion in publicly accessible areas of WetDawg.com are the responsibility of the creator. WetDawg.com makes no claims or warranties about such information or its authenticity. Upon posting any content on WetDawg.com, you grant WetDawg.com the non-exclusive right to publish, modify and use such content solely for the purpose of displaying such content.

4. Intellectual Property

A) It is the policy of WetDawg.com to respond expeditiously to claims of intellectual property infringement. WetDawg.com will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA"). Should a violation of intellectual property be discovered, the document(s) or messages in such violation will be removed in a timely manner after any and all investigating has been completed to prove the authenticity of such a claim.

B) Materials accepted by WetDawg.com submitted by you automatically grant WetDawg.com the royalty-free, perpetual, irrevocable, non-exclusive and fully sublicensable right to use, copy, modify, publish, translate, distribute, transmit and publicly display such materials worldwide for any purpose whatsoever without any compensation to you, UNLESS PRIOR ARRANGEMENTS HAVE BEEN MADE. WetDawg.com may incorporate such materials in any form it chooses. You are free to display and print for your personal, non-commercial use, information you receive through WetDawg.com. But you may not otherwise reproduce any of the materials without the prior written consent of the owner. Of course, you're free to encourage others to access the information themselves on WetDawg.com and to tell them how to find it.

5. Proprietary rights

A) All material on this site, including all information, pictures, graphics, interfaces and text contained on this site, as well as the organization and layout of the site, are the property of WetDawg.com and are protected by copyright laws. No material from this site may be reproduced, published, translated, distributed or displayed without written permission from an officer of WetDawg.com. Under no circumstances should anyone claim any of the site's content as one's own work.

B) All trademarks, service marks and trade names are proprietary to WetDawg.com and other respective owners that have granted WetDawg.com the right and license to use such marks.

This site includes links to other Internet sites as a convenience for our users. WetDawg.com does not endorse these sites or guarantee the information on the sites, which are administered by others, and WetDawg.com does not assume responsibility or liability for any materials or information available at linked sites.

7. Disclaimer of warranties

A) Use of WetDawg.com is at your sole risk. The site is provided on an "as is" and "as available" basis with no warranty of any kind. WetDawg.com reserves the right, at its sole discretion, to immediately, without notice, suspend or terminate (i) these Terms of Use; (ii) your registration with or ability to access this site and/or any other service provided to you by WetDawg.com upon any breach by you of the Terms of Service.

WetDawg.com and its suppliers may make improvements or changes in the information, services, products and other material on this site, or terminate this site, at any time without notice.

12. WetDawg Privacy Statement

A) WetDawg.com is very sensitive to the issues of online privacy and electronic security. As we establish and maintain an online relationship with you, we want you to know we will always do whatever possible to ensure a secure and private environment to maintain your unquestioned trust.

B) WetDawg gathers information through various submission forms (Reports, Contests, Destinations, Events, Galleries, Message Boards, and Clubs) and in all store order forms. Information gathered includes name, email address, physical address, telephone number, general demographic information, and credit card information. The information gathered in submission forms is used to (1) post the information which is being submitted to the community site and facilitate interaction among community users and (2) assist us in making the community site a better place for our visitors. Information gathered during the ordering process is used exclusively to process the order. Our store uses Secure Socket Layer (SSL) technology to insure that your purchasing information remains secure within our site. Any financial information that is collected is strictly limited in use to processing the order. We do not sell or give your personal information to third parties. If at some point in the future, there is a change to our information usage practices that affect your personal information, we will notify you by email of the relevant changes. At that time, or any other time, if you wish to change, edit or delete any information you have provided us or opt-out of our information usage practices, please email Natasha Nowakowski at Natasha@wetdawg.com with a description of the action you would like us to take. We will be happy to honor your request. In addition, you should also check this posted privacy statement for changes.

C) When a submission or order form is completed a cookie is placed on your computer. A cookie is nothing more than a small amount of information about you that is stored onto the computer's hard disk. Once the cookie is in place, we can recognize your future visits by accessing this piece of information. We use cookies to keep track of your name, email and shopping cart. This facilitates your future uses of the community. If your browser is set to not accept cookies, you will be unable to submit information to the site or finalize a purchase electronically. However, any of our customer service specialists will by happy to assist you via telephone at 1-877-WET-DAWG.

D) From time to time, we may send out information about our community to the users who have submitted information to the site and/or ordered products from us. These mailings may include newsletters (which is an opt-out option in the submission areas), notifications of new and improved site areas, technological implementations and product promotions. If you do not wish to receive this information, please email Natasha@wetdawg.com with a subject line indicating your desire to be removed from our mailing list.

E) To protect the security of your personal information, only those WetDawg.com employees with a need to know are permitted access to it. This includes our webmaster, Web store manager, controller and shipping personnel (excluding financial information). Access is limited through the use of passwords and through restricted document access procedures (e.g., locked storage in locked down areas of the physical facility). As mentioned above, the store in the community site uses SSL technology to establish a secured shopping area before gathering any sensitive financial information of our customers. 13. Other

These terms shall be governed by and construed in accordance with the laws of the State of Oregon, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the state or federal courts located in Lane County, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then such provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions
